Short-Term Rental Agreement (Guest)

This Rental Agreement is between the Property Owner (the "Owner"), acting through Stardrive Inc. (d/b/a StayPilot) solely as Owner's limited coordination agent ("Manager"), and the undersigned guest ("Guest") for the property identified in the reservation confirmation (the "Property").

1. The Parties' Roles

Guest's contract for occupancy is with Owner. Manager operates the communications, access, and payment platform on Owner's behalf and is not the owner, landlord, or innkeeper of the Property. Any claim relating to the condition of the Property is against Owner.

2. Reservation, Payment, Deposit

Occupancy is limited to the confirmed dates, the confirmed guest count (never exceeding the posted maximum), and lawful purposes. Payment per the reservation schedule; failed payments not cured within 48 hours of final retry cancel the reservation per the cancellation policy. A security deposit or damage waiver applies as stated in the reservation; the deposit may be applied to damage, excess cleaning, unauthorized pets or guests, smoking remediation, and unreturned property, with an itemized statement provided.

3. Access; Verification

Door codes are personal to Guest, activate at check-in and expire at check-out, and may not be shared. Guest consents to identity verification as a condition of receiving access. Manager may revoke access on termination of this Agreement for material breach (illegal activity, safety threats, occupancy or party violations) following notice where legally required.

4. House Rules; Conduct

Guest will comply with posted House Rules, quiet hours, occupancy/parking limits, and HOA/building rules provided with check-in instructions. No parties or events unless approved in writing. No smoking indoors. Pets only where the listing allows and fees are paid.

5. Guest Responsibility

Guest is responsible for: (a) damage to the Property or its contents beyond normal wear caused by Guest or Guest's invitees; (b) losses from violating this Agreement; (c) supervision of minors; and (d) securing the Property (locking doors, closing windows) during the stay. Guest authorizes charging the payment method on file for documented amounts under (a)–(b), with itemized notice.

6. Property Conditions; Assumption of Risk

Amenities (pool, hot tub, dock, bicycles, kayaks, grills, and similar) are used at Guest's own risk; Guest assumes risks inherent to such amenities and to waterfront/outdoor environments, and accepts responsibility for compliance with posted amenity rules. Guest will promptly report hazards, malfunctions, and damage through the platform so they can be addressed.

7. Service Interruptions; Remedies

Owner's sole obligation for a Property condition failure (e.g., HVAC, appliance, utility, or amenity outage) is commercially reasonable repair after notice, and, where the failure materially impairs the stay, a fair-value refund or credit determined per the posted policy. Neither Owner nor Manager is liable for consequential losses (travel costs, substitute lodging beyond the posted policy, lost enjoyment) to the extent permitted by law. Manager itself has no liability for Property conditions; Manager's aggregate liability from any cause is limited to fees Manager retained from this reservation.

8. Communications & Automation Consent

Guest consents to receive transactional communications (email/SMS/platform messaging) about the stay, and acknowledges that responses and stay coordination may be AI-assisted or automated, with human escalation available on request. Message/data rates may apply. See the AI & Automation Disclosure and Privacy Policy, incorporated by reference. No hidden interior surveillance exists; any exterior security devices and noise-level sensors (non-audio-recording) are disclosed in the listing.

9. Indemnity

Guest will indemnify and hold harmless Owner and Manager from claims arising from Guest's or Guest's invitees' negligence, willful acts, or breach of this Agreement, except to the extent caused by the indemnified party's own negligence or misconduct.

10. General

Governing law: Florida; venue in the county where the Property is located. If any provision is unenforceable, the remainder stands. This Agreement, the reservation confirmation, the House Rules, the AI & Automation Disclosure, and the Privacy Policy are the entire agreement. Electronic signature/acceptance is binding.
